lex solutionis

Litigation & Disputes / Private International Law / Defined Legal Terms & Phrases
; Updated: 23 March 2015

The law of the place where a contract is to be performed or where a debt is to be paid. As such, this is the law that will govern the timing for payment of a debt.

The term may have relevance in international disputes and litigation where the parties have not agreed to the law to govern the interpretation of a contract.

If a contract specified that goods were to be shipped from England and delivered to New York in the United States, the lex solutionis would be the laws of New York and, provided legal proceedings were commenced in England, the lex fori would be the laws of England.

Usage: The contract was performed in Manchester, and as a result the lex solutionis was the laws of England.
