judgment debtor

Litigation & Disputes / Civil Lawsuits / Judgments

A judgment debtor is a person against whom a judgment or court order has been made. Unless the order specifies otherwise, money judgments are payable within 14 days to the judgment creditor and immediately enforceable thereafter if the sum is not paid. The time for payment however may be varied by an order of the Court.

Judgments may arise as a result of any number of events in litigation, which include default judgment, summary judgment, after a strike out application, or as a result of an interim costs order, or judgment.

Judgments and courts are able to be enforced unless the court has ordered a stay of execution. An appeal of a decision including an order to pay money is not automatically stayed as a result of the filing of an appeal or application for permission to appeal.
